How Is Child Support Calculated?

Texas courts employ a formula to determine the amount of child support that is in a child’s best interests. It generally accounts for the monthly resources of each parent, but that’s not all.

Who Must Pay Child Support in Texas?

In Texas, the noncustodial parent will generally pay child support to the custodial parent. The custodial parent is the one who has primary physical custody. The noncustodial parent is the one who has the child for less time.

It’s important to note that the law states both parents may be obligated to pay child support, depending on the child’s best interests. 

When Does the Obligation Begin?

Child support obligations usually begin when a court order is established. This can happen during a divorce, a suit affecting the parent-child relationship (SAPCR), or through the Office of the Attorney General's Child Support Division.

How Long Does Child Support Last?

In most cases, child support continues until the child:

  • Turns 18 years old and graduates from high school
  • Turns 19 years old (even if still in high school)
  • Gets married
  • Enlists in the military
  • Passes away
  • Is otherwise emancipated by court order

Modifying or Enforcing Your Child Support Order
