How Paternity Is Established in Texas

Texas law provides two primary paths for establishing paternity: voluntary acknowledgment and court-ordered adjudication. Which path applies depends on whether both parents agree on the question of fatherhood.

Voluntary Acknowledgment of Paternity

When both parents agree, they can sign an Acknowledgment of Paternity form. This is most commonly done at the hospital at birth, but it can also be completed later through an AOP-certified entity such as a local child support office or birth registrar. These entities are trained and authorized by the Office of the Attorney General to help parents complete the process. A properly signed and filed acknowledgment carries the same legal weight as a court order.

Court-Ordered Adjudication of Parentage

When paternity is disputed, either parent, the child, or the state may file a Petition to Adjudicate Parentage in the district court of the county where the child resides. In Brazoria County, those petitions are filed in the Brazoria County District Courts, seated in Angleton. If the alleged father disputes the claim, the court can order DNA genetic testing, typically a cheek swab of the child, the mother, and the alleged father. If the alleged father fails to appear after proper notice, the court may enter a default order declaring him the legal father.

The Texas Attorney General’s Child Support Division can also initiate the paternity process administratively when a custodial parent seeks public assistance and the noncustodial parent’s identity isn’t established. When a child has a presumed father, Texas law generally requires that a suit to adjudicate parentage be filed within four years of the child’s birth, though exceptions apply. Waiting can limit a father’s ability to assert parental rights, so acting early matters.

What Follows After Paternity Is Established

An order establishing paternity is the starting point, not the finish line. Once paternity is in place, Texas courts can address conservatorship (legal custody), possession and access (visitation), and child support, all governed by the Texas Family Code and decided under the best interest of the child standard.

Either parent can later seek modification of a custody or support order if there has been a material and substantial change in circumstances. Paternity-related orders aren’t permanently fixed; as situations evolve, the legal framework can be revisited through the courts.
